Privacy and Cookie Statement Staxter GmbH

The use of our website and app is possible without disclosing personal data. For the use of individual services of our website, different rules can apply, in this case discussed separately below. Your personal data (e.g. name, address, email, phone number, etc.) will be processed by us only in accordance with the provisions of German data protection law. Data becomes linked to a person, if they can be identified with a specific real person. The legal basis of the data protection can be found in the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG). The following regulations inform the extent of the nature, scope and purpose of the data collection, the use and processing of personal data by the provider.

Cookies

We use cookies on our site to detect the multiple use of our service, by the same user/ Internet connection owners. Cookies are small text files that are stored and saved by your Internet browser on your computer. They are used to improve our website and our service. These are usually called "session cookies", which are deleted after the end of your visit.

In part, these cookies usually provide information to automatically recognise you again. This acquired information is used to improve our services and to allow you easier access to our site.

You may refuse the use of cookies by selecting the appropriate settings on your browser; however, we would like to point out that you may not be able to use all features of our website in this case.

Server data

For technical reasons the following data, but not limited thereto, will be submitted to us and to our web hosting service, by your web browser (known as server log files):

- website from which you reached us (referral URL)
- the website you are visiting (landing pages) 
- date and time of access 
- your IP-address

This anonymous data will be stored separately from your personal data and can therefore not be linked to an individual person. The data collected are only used to make statistical evaluations in order to improve our offers and website.

Registration Feature

We offer you the opportunity to register on our website or mobile application. In the course of this registration, the data entered into the input screen of the registration form, which appear in the appropriate input box of the registration form, such as your name, e-mail, etc. is collected and stored solely for the use of our service. By registering on our site, we will also collect your IP address and the date and time of your registration. This is a safeguard on our part in the event that a third party abuses your data and registers your information to our site without your knowledge. When ordering via Staxter, we also record your address and store it in your profile. Disclosure to third parties will not take place.

Mobile Application

When you download our mobile application and use our services, we automatically collect information on the type of device you use, operating system version, and system and performance information.

We send you push notifications from time-to-time in order to update you about any events or promotions that we may be running. If you no longer wish to receive these types of communications, you may turn them off at the device level. To ensure you receive proper notifications, we will need to collect certain information about your device such as operating system and user identification information.

We collect your location-based information for the purpose of tailoring certain offers that may be relevant to you in the location you are at. You may opt-out of location based services at any time by editing the setting at the device level.

We use mobile analytics software to allow us to better understand the functionality of our mobile software on your phone.

Use of Google Analytics with Anonymity Feature

We use Google Analytics on our website and in our mobile application. Google Analytics is an analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 United States, hereinafter "Google" that allows us to analyse and better understand the functionality of our website and mobile application on your device. Google Analytics uses "cookies", text files that are stored on your computer and thereby allow analysis of your use of our website. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, your IP address, and where the application was downloaded from. We do not link the information we store within the analytics software to any personally identifiable information you submit within the mobile application.

The information generated by these cookies, e.g., time, place and frequency of your Website visits including your IP address, will be transferred to Google in the US and stored there. 

We use Google Analytics with the extension "get._anonymiseIp" on our website. In this case, within the European Union or in other countries in contractual agreement with the European Economic Zone, your IP address will be condensed and thereby made anonymous. 

Google will use this information to evaluate your use of the website or mobile application, compiling reports for us on website or mobile application activity and providing more related services to website or mobile application and Internet usages. Google may also transfer this information to third parties, provided that it is required by law or where such third parties process the information on Google's behalf. 
Google will, by its own account, not associate your IP address with any other data held by Google. You can prevent the installation of cookies by selecting the appropriate settings on your browser software; however, we point out that you may not be able to use all features of our website in this case.

In addition, Google provides, for the most common browsers, a deactivation add-on, which gives you more control over which data is collected by Google from an opened website. The add-on communicates with JavaScript (ga.js) to Google Analytics that no information should be submitted of the visited sites. The deactivation add-on for browser from Google Analytics does not prevent that information from being transmitted to us or to others of our web analytics services. Social Plugins

Use of Facebook. Plugins from the social network Facebook (Facebook Inc., 1601 Willow Road, Menlo Park, California, 94025, USA) are integrated in our Services. You can recognise the Facebook plugins from the Facebook logo or the "Like button" on our page. You can find an overview of the Facebook plugins here: http://developers.facebook.com/docs/plugins/.

If you visit our Services and click on the Facebook plugin, a direct connection will be established between your browser and the Facebook server. Facebook thereby receives the information that you have visited our site with your IP address. If you click on the Facebook "Like button" while you are logged into your Facebook account, you can link the contents of our pages to your Facebook profile. Thereby, Facebook can associate the visit to our Services with your user account. We hereby point out that as provider of the Services, we do not receive any information on the contents of the data transmitted or their use by Facebook. Use of Twitter. Functions of the Twitter service are integrated in our Services. These functions are offered by Twitter Inc., Twitter, Inc. 1355 Market St, Suite 900, San Francisco, CA 94103, USA. By using Twitter and the "re-tweet" function, the websites visited by you are linked to your Twitter account and announced to other users. Data are thereby also transmitted to Twitter.

Use of LinkedIn. Our Services use functions of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA (hereinafter: "LinkedIn"). If you visit our Services and click on the LinkedIn plugin ("recommend button"), a connection to the LinkedIn servers will be established. LinkedIn will be informed that you have visited our Services with your IP address. If you click on the LinkedIn "recommend button" and are logged into your LinkedIn account, it is possible for LinkedIn to associate your visit to our Services with your user account. We hereby point out that as provider of the pages, we do not receive any information on the contents of the data transmitted and their use by LinkedIn.

Data Storage

We are using Amazon Web Services (AWS) as a cloud services provider. All of your data are stored and secured in an AWS data center in Frankfurt am Main, Germany. All the data stored by us are under our exclusive control and cannot be accessed by AWS.

Help Center / Contact

We offer you the opportunity to contact us by e -mail and/or via a contact form on our website and mobile application. In this case, the information provided by you is stored for the purpose of processing your contact.

We use Freshdesk, a service of Freshworks, Inc., 1250 Bayhill Drive, Suite 315, San Bruno, CA 94066, USA as a help center solution on our website and in our app. If you use the Help Center and make a request, certain personal data, such as, for example, your given and last name, your e-mail address, will be collected from you and saved by Freshdesk. Depending on the nature of your request, further data such as, for example, your address or mobile phone number may also be collected and stored. These data are hosted by Freshdesk in a data center in Frankfurt am Main. Because Freshdesk uses third-party applications, your data may however be processed and stored temporarily outside the EU. Therefore, we have entered into contractual agreements with Freshworks, Inc. to ensure that adequate levels of data protection (EU standard contractual clauses) are nevertheless ensured.

A matching of the data collected with data that may be collected from other components of our website will not take place.

Security

The security of your personal information is important to us. Data that you enter into our website or app for the purpose of using our service will be encrypted and stored using reasonable security measures. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. Information / Revocation / Cancellation

You can contact us free of charge in reference to Federal Data Protection Act questions for the collection, processing or use of your personal data and their rectification, blocking, erasure or a revocation of a given consent. We remind you that you have a right to rectify inaccurate data or delete personal data; this claim should preclude any legal obligation to retain.

Messages (such as e.g. gift notifications) within Staxter will only be stored and shown in your Staxter profile for a limited time period of 2 months from their creation. At the lapse of this time period messages are deleted automatically and cannot be restored. With automatic deletion, access to these messages in your Staxter profile is no longer possible. Note however, that messages of the type “gift” will not be deleted if the user has not finally accepted or rejected the gift. These messages will only be deleted 2 months from such final acceptance or rejection.

Upon cancellation (closing) of your account your login name (email) will be erased immediately.

Upon cancellation (closing) of your account all other user-related data such as e.g. your user id (given name and last name) and your address will be marked as to be deleted within 4 weeks.
